Principal Magistrate Rose Ndombi has scheduled the hearing for the case involving Nicholas Otieno Ndolo and lawyer Thomas Otieno Ngoe for September 24, 2024.

The two individuals are facing serious allegations related to a gold fraud scheme amounting to Sh 134 million, in which they are accused of defrauding a foreign national, Seth Adam Bernstein, of USD 1 million (approximately Sh 134 million) under the pretense of facilitating the shipment of gold to Dubai.

According to the charge sheet, the alleged incident took place on February 11, 2024, in Nairobi, where Ndolo and Ngoe purportedly misled Bernstein by claiming that DSI Mining and Minerals Company Limited was capable of covering the customs duties for 3,000 kilograms of gold intended for export.

Additionally, Ndolo is charged with the creation of a fraudulent mineral export permit, referenced as No.EAC/22/92709141708/2022, dated May 16, 2022, which further underscores the gravity of the accusations against him. Both defendants have denied the charges and were subsequently released on cash bail set at Sh 1 million each.
