A complainant in the case against former company director Honey Khatwani, who faces charges of fraud exceeding Sh 350 million, has expressed concerns that the Investigation Officer is intentionally delaying proceedings through various tactics.
During a court appearance today before Magistrate Dolphina Alego, the Director of Public Prosecutions (DPP) was given a final opportunity to provide the necessary documentary evidence and materials to the defense, which is essential for the case to proceed. This directive came after the Investigation Officer failed to present the required documents.
The DPP requested a one-week adjournment to gather the materials, a request that was contested by the defense, which argued that the delay is adversely affecting their client, who is eager for the case to be resolved promptly.
In her ruling, Magistrate Alego scheduled the hearing for July 10, 2025, after both the defense and prosecution agreed to conduct the pre-trial on the same day and ensure the documents are supplied to the defense. According to the charge sheet, Khatwani is alleged to have misappropriated funds on various occasions between January 1, 2020, and June 30, 2024, in Baba Dogo, Nairobi County, with the prosecution asserting that he acquired the money due to his role as a director. Currently, he is out on a cash bail of Ksh 5 million, with an alternative bond set at Ksh 10 million.
Additionally, there are claims that Khatwani has been intimidating witnesses, leading to concerns among complainants that influential businessmen and investigators may be obstructing the case.
